Terms of Use – Mentastic

Approved and effective from 07.07.2025

This End-User License Agreement (“EULA”) constitutes an agreement between you and Mentastic OÜ (hereinafter the “Owner”), the developer of the Mentastic mobile application (the “Software” or “App”). By downloading, installing, or using the App, you agree to the terms of this EULA. If you do not agree, do not use the App.

1. LICENSE

The App is licensed, not sold. You are granted a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on a compatible device.

2. RESTRICTIONS

You agree not to:

Distribute or sublicense the App;
Reverse engineer or modify the App;
Use the App for unlawful purposes or in violation of applicable terms;
Circumvent any technical protection measures or usage limitations.

3. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the App and its contents (including text, images, algorithms, and data) remain with the Owner. You agree not to infringe or misuse any intellectual property.

4. DISCLAIMER OF WARRANTY

The App is provided “AS IS” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, nor do we provide any warranty regarding the accuracy or completeness of any content.

5. LIMITATION OF LIABILITY

The Owner shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the App. This includes, but is not limited to, emotional distress, data loss, or device malfunction.

6. MEDICAL DISCLAIMER

Mentastic does not provide medical advice, diagnosis, or treatment. It is a self-help tool intended for reflection and well-being support. For any medical concern, consult a licensed healthcare provider.
The content provided by Mentastic, including responses generated by the AI-powered language model, is intended for self-reflection and informational, educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment from a licensed mental health provider or other qualified health professional.
Use of this application does not establish a doctor-patient or therapist-client relationship. The app does not offer crisis support, personalized medical recommendations, or therapeutic interventions. Always seek the advice of your psychologist, psychiatrist, or other qualified health provider with any questions you may have regarding a medical or mental health condition.
If you are experiencing a medical or mental health emergency, or if you are in crisis or thinking about harming yourself or others, call 112 (or your local emergency number) immediately or contact a licensed crisis line or mental health professional in your area.
Mentastic uses a large language model (LLM) to generate responses based on user input. The AI may sometimes provide inaccurate or outdated information, and it does not have awareness of your personal medical history, context, or emotional state. The developers and operators of this app make no guarantees about the accuracy, relevance, or safety of its responses. By using this app, you acknowledge and agree that:
- You are solely responsible for how you use the information provided.
- You will not disregard professional medical advice or delay seeking it because of something you read or heard through this app.
- You understand the AI is not a licensed mental health professional.

7. ACCESS, REGISTRATION, AND PRICING

The Mentastic App is currently offered free of charge, and no subscription or one-time payment is required to access its features.
However, due to the App’s focus on mental well-being and its classification as operating in a high-risk domain, access is subject to the following conditions:

The App is unlisted on public app stores and is not publicly searchable.
Registration is mandatory. Users must complete the designated sign-up process in full to access the App.
Unregistered or improperly registered accounts may be revoked or denied access without notice to protect user safety and platform integrity.
This controlled access approach allows the Owner to better manage user safety, reduce the risk of self-harm, and monitor responsible use of the App.
Access is granted via secure identity management, and users who breach terms or demonstrate high-risk behavior may be temporarily or permanently suspended (see Section 14).

The Owner reserves the right to change access conditions or introduce paid plans in the future, with appropriate notice and user consent.

8. PLATFORM-SPECIFIC TERMS

A. Apple App Store

If you downloaded the App from the Apple App Store:

This EULA is between you and Mentastic OÜ, not Apple Inc.
Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support.
If the App fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price (not applicable); Apple has no further obligations.
You must comply with Apple’s App Store Terms of Service.
You may only use the App on Apple-branded devices you own or control.

B. Google Play Store

If you downloaded the App from Google Play:

Your use of the App is also subject to Google’s Terms of Service.
Refund requests are subject to Google’s policies (not applicable).
Google is not a party to this EULA and has no responsibility for the App or its content.

9. PRIVACY AND DATA

Our Privacy Policy explains how we collect, use, and protect your data. By using the App, you consent to the data practices described in that policy.

10. UPDATES AND MODIFICATIONS

We may modify or update the App and its features at any time. Such updates may be required for continued use. We reserve the right to discontinue features or make access conditional on updates.

11. TERMINATION

This license is effective until terminated. It will terminate automatically if you fail to comply with the terms herein. Upon termination, you must delete the App and cease all use.

12. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the updated terms.

13. GOVERNING LAW

This agreement shall be governed by the laws of the Republic of Estonia, without regard to its conflict of law principles.

14. ACCOUNT SUSPENSION AND ACCESS RESTRICTION

The Owner reserves the right to temporarily or permanently restrict access to the App if a user is found to be in violation of this EULA, our Privacy Policy, or if their behavior threatens the integrity, safety, or intended purpose of the App.
